These Terms of Service ("Terms") govern your access to and use of sendmoss.com and all products, tools, and services offered by SendMoss ("we", "our", "us"). By creating an account, making a purchase, or using any part of our platform, you confirm that you have read, understood, and agree to be bound by these Terms in full. If you do not agree, do not use our services.

1. About SendMoss

SendMoss operates sendmoss.com and provides digital marketing software including SMS senders, email marketing tools, phone validation tools, lead generation tools, and related downloadable and subscription-based products. Our services are available to users worldwide.

2. Eligibility

2.1 Age Requirement

You must be at least 18 years old to create an account or purchase any product on SendMoss. By registering, you confirm that you meet this requirement. If we discover an account belongs to a minor, it will be terminated immediately.

2.2 Accurate Information

You agree to provide accurate, complete, and up-to-date information when registering. Providing false information — including fake names or email addresses — may result in immediate account termination.

2.3 Worldwide Access

SendMoss is available to users worldwide. You are responsible for ensuring that your use of our tools complies with the laws of your country or region. We reserve the right to restrict access from specific regions if required by law.

3. Accounts

3.1 Account Registration

Each account is registered to one individual or business entity. You are responsible for all activity that occurs under your account, including purchases made and how our tools are used.

3.2 Account Sharing and Team Access

Your SendMoss account login credentials may be shared with team members within your own organisation for the purpose of using your purchased tools. However, you may not transfer, sell, or give your account to any unaffiliated third party. The account owner is fully responsible for all team members who access the account.

3.3 Email Address

Your email address is your permanent account identifier. It cannot be changed after registration. If you need to update your email address, contact us at support@sendmoss.com.

3.4 Account Security

You are responsible for keeping your credentials secure. We recommend enabling two-factor authentication (2FA), which is available in your security settings. If you suspect unauthorised access, notify us immediately at support@sendmoss.com. We are not liable for losses resulting from unauthorised use of your account due to your failure to maintain credential security.

3.5 Account Deletion

You may permanently delete your account at any time from your profile settings. Deletion is immediate and irreversible — all your data is permanently removed. See our Privacy Policy for full details on what is deleted.

4. Products and Licenses

4.1 One-Time Downloadable Products

Purchasing a downloadable product grants you a non-exclusive, non-transferable, personal license to use that software. This license is for your own use or your organisation's internal use only. You may not:

Subscription products provide monthly access to software tools via a license key assigned to your account. Your license key is personal to your account. You may not:

4.3 Free Trials

Certain subscription products include a set number of free trial uses before a subscription is required. Trial access is intended for one account per user per product. The following are strictly prohibited:

4.4 Permitted Use

All SendMoss products are licensed for personal use or internal team use only. You may not use our tools or their outputs as the basis of a standalone commercial product you sell or distribute to others.

5. Payments and Billing

5.1 Pricing

All prices are displayed in USD. Prices are subject to change. Existing active subscriptions will not be affected by price changes until renewal, where reasonable notice will be given.

5.2 Payment Methods

We accept card payments and cryptocurrency (including BTC, ETH, USDT, LTC, DOGE, TRX, BNB, SOL, and XMR). All payments are processed by secure third-party payment providers. We do not store your card number or cryptocurrency wallet keys.

5.3 Subscription Billing

Subscriptions are billed on a monthly cycle. By subscribing, you authorise us to charge your chosen payment method at each renewal period. Your access continues until the end of the current billing period whether you use the service or not.

5.4 Cancellation

You may cancel your subscription at any time from your dashboard. Cancellation stops future renewals. You retain access until the end of your current paid period. No partial refunds are issued for unused days within an active billing period unless covered by our refund policy.

5.5 Failed Payments

If a payment fails or is not completed within the allowed window, your subscription access will be suspended until payment is resolved. You will receive email reminders before and after expiry.

5.6 Chargebacks

Filing a fraudulent chargeback or payment dispute while retaining access to our products is considered a violation of these Terms and will result in immediate account termination and a permanent ban from the platform.

We offer a 7-day refund window from the date of subscription purchase. If you are not satisfied, contact us within 7 days at support@sendmoss.com or via our contact page.

7. Acceptable Use

You agree to use SendMoss and all its tools responsibly and legally. The following are strictly prohibited:

7.1 Illegal Messaging

Using our SMS or email tools to send spam, unsolicited commercial messages, or communications that violate applicable laws including but not limited to the CAN-SPAM Act, the Telephone Consumer Protection Act (TCPA), GDPR, and CASL. You are solely responsible for obtaining proper consent from recipients before sending messages.

7.2 Harassment and Harm

Using our tools to harass, threaten, stalk, defame, or harm any individual, group, or organisation.

7.3 Malicious Activity

Distributing malware, viruses, phishing content, or any malicious code through or in connection with our platform or tools.

7.4 Reverse Engineering

Attempting to decompile, disassemble, reverse engineer, or extract source code from any of our software products.

7.5 Platform Abuse

Scraping, crawling, or systematically extracting data from our website or platform. Attempting to gain unauthorised access to any part of our systems. Using bots or automated tools to interact with our platform in ways not explicitly permitted.

7.6 Circumventing Controls

Attempting to bypass, clone, exploit, or manipulate our license key system, payment system, trial limits, or access controls in any way.

7.7 Illegal Purposes

Using any SendMoss tool for any purpose that is illegal under applicable local, national, or international law.

You are solely responsible for the content of any messages sent using our tools and for compliance with all applicable laws in your jurisdiction. SendMoss provides software infrastructure — we are not responsible for how users choose to deploy it.

8. Violations and Account Termination

Any breach of these Terms — including but not limited to license key sharing, fraudulent chargebacks, illegal use of our tools, trial system abuse, or platform scraping — will result in immediate account suspension and permanent termination without refund.

We reserve the right to terminate any account at our sole discretion if we determine it poses a legal, reputational, or operational risk to SendMoss or its users.

You may appeal a termination decision by contacting support@sendmoss.com within 7 days of the termination notice. Appeals are reviewed on a case-by-case basis and our decision is final.

9. Intellectual Property

All software, content, branding, design, logos, and materials associated with SendMoss are the intellectual property of SendMoss and are protected by applicable copyright, trademark, and intellectual property laws.

Nothing in these Terms grants you any ownership of our intellectual property. You may not use our name, logo, brand assets, or any proprietary content without prior written consent. Unauthorised use of our intellectual property may result in legal action.

10. Disclaimers

Our platform and tools are provided on an "as is" and "as available" basis without warranties of any kind, express or implied. We do not warrant that:

Use of our tools is entirely at your own risk. You are responsible for testing tools using the free trial before subscribing.

11. Limitation of Liability

To the maximum extent permitted by applicable law, SendMoss shall not be liable for any indirect, incidental, special, punitive, or consequential damages arising from your use of or inability to use our services — including but not limited to lost profits, lost data, business interruption, or reputational damage — even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for any claim arising out of these Terms or your use of our services shall not exceed the amount you paid to SendMoss in the 3 months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless SendMoss and its team members from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from:

We may update these Terms at any time. When we do, we will revise the "Last updated" date at the top of this page. For material changes, we will notify registered users by email at least 7 days before the changes take effect. Continued use of SendMoss after that date constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the United States. Any disputes arising from these Terms or your use of SendMoss will first be addressed through good-faith negotiation. If a resolution cannot be reached, disputes will be subject to binding arbitration under applicable US arbitration rules.
